Dandenong Ranges Tree Removal

Tree removal in Emerald

Emerald grew out of a plant nursery, and its oaks, elms and hedges are part of the planning rules. Here the permit is about any vegetation, not only big trees.

The rule in Emerald

We sampled 25 points around the township, and 23 fell inside Emerald. Every one of the 23 was in Cardinia and under an overlay that controls vegetation: the Puffing Billy corridor overlay SLO1 at 13, VPO1 at 9, ESO1 at 7, VPO2 at 3 and the town centre's VPO3 at 2. None of them sets a minimum size.

Any size
A permit is needed for any vegetation unless an exemption covers it. A shrub counts, and so does a hedge.
10 m6 m
Drawn to scale around a 12 m by 9 m house. The dashed ring is a state rule; the solid ring is a council overlay.
6 m
Vegetation within 6 m of an existing house is exempt on a lot under 0.4 ha. SLO1, VPO1, VPO2 and ESO1 all have this. VPO3, in the town centre, does not.
10 m
The 10/30 rule for a house built or approved before 10 September 2009. All 23 points were in a Bushfire Prone Area. How it works.

The schedules also leave out the part of a tree hanging over a home's roof where cutting it is needed for fire protection, normal pruning that leaves the plant in place, and the environmental weeds they list. A dead tree is exempt only once a council officer has assessed it, and never when it is standing and 40 cm or more across.

A nursery town's trees

C. A. Nobelius started his nursery here in 1886, on 180 ha. The Emerald Country Club took the northern part of it in 1923. VPO3's own statement credits that horticultural past for many of Emerald's exotic street trees, and several now have heritage tree controls of their own:

  • The Dutch elm and oaks along Station Avenue, William Street and Ambrose Street (HO255).
  • The beech on the railway reserve in Sellers Road (HO254), and the pin oak on the Emerald-Monbulk Road (HO249).
  • The cherry laurel hedge on the Beaconsfield-Emerald Road (HO250).
  • Emerald Lake Park (HO106), Emerald Reserve (HO181), the railway station (HO176) and the Puffing Billy line itself (HO4).

On a heritage place with tree controls, removing a tree needs a heritage permit. The exotic trees elsewhere are another matter. Oaks, maples, chestnuts and willows are on the overlays' environmental weed list, with a condition: a trunk no more than 40 cm across at 1.3 m. A bigger one needs a permit, and the council can confirm how the condition applies to a smaller one. Your property report shows whether your block has an HO number.

The town centre and its hedges

VPO3 covers the Emerald town centre. It needs a permit to remove, destroy or lop any vegetation, and it names the hedges along the Belgrave-Gembrook Road. It has the same exemptions as the other Cardinia overlays, except the 6 m one near a house. In the centre, a hedge beside the house needs a permit unless the 10/30 rule covers it.

The town centre's design overlay, DDO4, and the low-density and township ones, DDO1 and DDO2, are about buildings. None of them needs a permit to remove a tree.

After a storm

Emerald's volunteer SES unit goes to several hundred storm and wind damage call-outs a year. Where a tree or limb is an immediate risk of injury or damage, each of these overlays lets the part that is the risk go without a permit. The rest of the tree still comes under the overlay, so a cleanup that goes further than the danger can need one.

The edges of Emerald

  • The far north is Yarra Ranges. A wider sample of 319 points across the whole suburb, reservoir included, put 20 there, all farmland under SLO6. That overlay needs a permit for native vegetation and trees over 1.1 m around, and exempts 4 m from a building.
  • The west has SLO4, the Menzies Creek valley overlay, at 9 of those points. It needs a permit for any vegetation, and its only listed exemption is sweet pittosporum. The state's exemptions still apply.
  • Three of the 23 points were residential zoning (NRZ1), where the state's canopy-tree rule can also apply.

The same Cardinia overlays: any size, 6 m on a lot under 0.4 ha.
Monbulk and Kallista
Yarra Ranges. Monbulk's township overlay catches trees over 50 cm around; Kallista's SLO1 starts at 1.1 m.
Macclesfield
SLO6, like Emerald's northern strip.

What's the job?

How tall the tree is, how close to the house, or whether you can get a truck in.

A photo of the whole tree and one of what's around it help with the quote.

Your name, number, what you write and your photos reach us by email and go on to a local arborist who works in the hills, and to no one else. We keep a note that a request came in, with the time, the page, the suburb and the job, so we can count them. Privacy.
